Please read these Terms carefully. By accessing or using GiveMood Radio, you agree to be bound by these Terms of Use. If you do not agree to these Terms, please do not use the Service.

1 Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and GiveMood Radio ("Company", "we", "us", or "our") governing your access to and use of the website, platform, and related services (collectively, the "Service") available at givemood.com and its subdomains.

By accessing or using the Service in any manner — including browsing the website, creating a radio station, or listening to a station — you represent that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization, business, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" refers to both you individually and that entity.

These Terms were last updated on September 20, 2026. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms.

2 Description of Service

GiveMood Radio is a web-based platform that enables users to create and share synchronized, continuous audio radio stations powered by publicly available YouTube playlists and albums. Key features of the Service include:

  • Station Creation: Users may create custom radio stations by submitting YouTube playlist URLs. Each station is assigned a unique identifier and is accessible via a shareable URL.
  • Synchronized Playback: All listeners who tune into the same station hear the same track at the same position in real time, creating a shared listening experience.
  • Live Listener Count: The Service displays an approximate count of concurrent listeners for each station using anonymous heartbeat technology.
  • Recently Played History: The Service maintains a local (device-side) history of recently played tracks for your convenience.
  • Progressive Web App: The Service is available as an installable PWA on compatible devices.

The Service acts exclusively as a player and synchronization layer for content hosted on and served by YouTube. We do not host, store, transcode, or redistribute any audio or video content ourselves. All media is streamed directly from YouTube's servers to your device via YouTube's official IFrame Player API in compliance with YouTube's Terms of Service.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you.

3 Eligibility

To use the Service, you must meet the following eligibility requirements:

  • Age: You must be at least 13 years of age. If you are between 13 and 18 years of age (or the applicable age of majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
  • Legal capacity: You must have the legal capacity to enter into a binding contract in your jurisdiction.
  • Not suspended: You must not have had your access to the Service previously suspended or terminated for violation of these Terms.
  • Compliance with laws: Your use of the Service must not violate any applicable local, national, or international laws or regulations.

By using the Service, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet these requirements, you must not access or use the Service.

4 Permitted & Prohibited Use

4.1 Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful, personal, and non-commercial purposes, including:

  • Creating radio stations from public or unlisted YouTube playlists you own or have permission to use.
  • Sharing station links with friends, family, or the public.
  • Listening to stations created by yourself or shared by others.
  • Using the Service as a background music source for personal, non-commercial activities.

4.2 Prohibited Use

You agree that you will not, under any circumstances:

  • Violate intellectual property rights: Create stations from playlists containing content that you do not have the right to use, redistribute, or synchronize in the manner facilitated by the Service.
  • Circumvent restrictions: Attempt to bypass, disable, or circumvent any technical protection measures, access controls, or security features of the Service.
  • Automated access: Use bots, scrapers, crawlers, scripts, or other automated means to access, query, or interact with the Service without our express written permission.
  • Abuse the infrastructure: Engage in actions that impose an unreasonable or disproportionate load on the Service's infrastructure, including denial-of-service attacks, flooding, or excessive API calls.
  • Impersonation: Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Illegal content: Use the Service to disseminate, promote, or link to content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Commercial exploitation: Resell, sublicense, or commercially exploit the Service or any portion thereof without our prior written consent.
  • Reverse engineering: Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the Service (except to the extent expressly permitted by applicable law).
  • Data harvesting: Collect or harvest any personally identifiable information from the Service, including listener data, station data, or user-generated content without our express permission.
  • Interference: Interfere with or disrupt the integrity or performance of the Service, or the servers and networks connected to it.
  • Facilitate prohibited activities: Assist, encourage, or enable any other person or entity to do any of the above.
Important: Stations must only use YouTube content that the playlist owner has the legal right to share publicly. Do not create stations using private, unauthorized, or copyright-infringing playlists. Violation may result in immediate removal of your station and prohibition from the Service.

5 User-Created Content

5.1 Your Responsibility

When you create a radio station, you are responsible for ensuring that:

  • The YouTube playlists or albums you link to are set to Public or Unlisted visibility on YouTube, enabling the YouTube player to access them.
  • You have the right, license, or permission to use the playlists in conjunction with the Service.
  • The station name and description you provide do not infringe any trademark, copyright, or other intellectual property right of any third party.
  • The station name and description are not misleading, defamatory, obscene, or otherwise in violation of these Terms or applicable law.

5.2 License to GiveMood Radio

By creating a radio station, you grant us a non-exclusive, royalty-free, worldwide license to display your station name, description, and associated metadata on the Service for the purpose of operating and promoting the Service. This license is limited to displaying this information to other users of the Service and does not extend to your underlying playlist content, which remains on YouTube.

5.3 No Endorsement

We do not endorse, verify, or take responsibility for any user-created stations or the content they play. The appearance of a station on GiveMood Radio does not constitute our endorsement of the station or its creator.

5.4 Station Removal

We reserve the right, in our sole discretion, to remove or disable access to any station that violates these Terms, any applicable law, or that we deem inappropriate, without prior notice and without liability to you.

6 Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, layout, code, logos, branding, and all other elements created by us (excluding content sourced from YouTube), is the intellectual property of GiveMood Radio and is protected by applicable copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material from our Service, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may share links to pages of our Service for lawful purposes.

6.2 Third-Party Content

All audio and video content played through the Service is hosted on and delivered by YouTube. Such content is the property of the respective content owners and is protected by copyright law. GiveMood Radio makes no claim of ownership over any third-party content and does not grant you any license to such content beyond what YouTube's own terms permit.

Your access to and use of YouTube content through the Service is additionally governed by YouTube's Terms of Service.

6.3 Feedback

If you submit ideas, suggestions, feedback, or improvements regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and incorporate such Feedback into the Service without any obligation to you.

6.4 DMCA & Copyright Infringement

We respect intellectual property rights. If you believe that any content accessible through the Service infringes your copyright, please note that the underlying content is hosted by YouTube and should be reported directly to YouTube via their DMCA Policy. If you believe our Service configuration itself (station names, descriptions) infringes your rights, contact us at the address in Section 13.

7 Third-Party Services & Links

The Service depends on and integrates with third-party services. Your use of the Service is subject to your compliance with the terms and policies of these third-party services:

You acknowledge that by using the Service, you are also subject to YouTube's Terms of Service as a condition of using the YouTube IFrame Player API embedded in our Service. We are not responsible for your compliance with, or any violation of, YouTube's Terms of Service.

The Service may contain links to external websites or services not operated by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We do not warrant the offerings of any third-party entities.

You acknowledge and agree that we shall not be liable for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available from third-party websites or services.

8 Disclaimers & Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location.
  • Any errors or defects will be corrected.
  • The Service is free of viruses or other harmful components.
  • The results of using the Service will meet your requirements.
  • Any particular YouTube playlist or content will remain available or playable at any given time.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GIVEMOOD RADIO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN ALL CASES, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ACCESS THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

8.3 Service Availability

We do not guarantee continuous, uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily limit or suspend access. We are not liable for any loss or damage arising from such interruptions.

Because the Service relies on YouTube's infrastructure, the availability of specific content and features may be affected by YouTube's own service disruptions, policy changes, or content removals. We are not responsible for any such disruptions or changes.

9 Indemnification

You agree to defend, indemnify, and hold harmless GiveMood Radio, its officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms.
  • Your use of the Service in a manner not authorized by these Terms.
  • Any station you create or content you submit to the Service.
  • Your violation of any applicable law, regulation, or third-party right, including but not limited to copyright, trademark, privacy, or publicity rights.
  • Any claim that your station or its content caused damage to a third party.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

10 Termination

10.1 Termination by Us

We reserve the right, in our sole discretion, to suspend or terminate your access to the Service and remove any stations or content you have created, at any time and for any reason, including but not limited to:

  • Violation of these Terms.
  • Receipt of a valid copyright or legal takedown notice.
  • Detection of fraudulent, abusive, or illegal activity.
  • Extended periods of inactivity.
  • Discontinuation of the Service.

We will endeavor to provide reasonable notice of termination where practicable, but reserve the right to act immediately in cases of serious violation or harm to the Service or other users.

10.2 Effect of Termination

Upon termination of your access to the Service:

  • All licenses and rights granted to you under these Terms will immediately terminate.
  • Any stations you created may be permanently deleted.
  • Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

10.3 Termination by You

You may stop using the Service at any time. If you have created a radio station and wish to have it permanently deleted, please contact us using the details in Section 13.

12 Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify users through a notice on the Service.

It is your responsibility to review these Terms periodically. Your continued use of the Service after any changes to these Terms constitutes your binding acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

For changes that materially and adversely affect your rights under these Terms, we will provide at least 14 days' advance notice where reasonably practicable.
